Article 1: General provisions

The electronic web shop of Hurray Retail (Skateshop.be), a BV with registered office at Europark-Zuid 7c 9100 Sint-Niklaas (Belgium), VAT BE0599985382, RPR Antwerpen, (hereinafter "Skateshop.be") offers its customers the opportunity to purchase online the products offered in the shop, including but not limited to shoes, clothing, skateboard hardware & accessories.
These Terms and Conditions ("Conditions") apply to all items in the Skateshop.be range and any purchase made by the customer with Skateshop.be.

The customer accepts that these Conditions will be the only ones applicable, to the exclusion of his own general or specific (purchase) conditions, even if these would stipulate that they are the only ones applicable.

 

Article 2: Price

 

All mentioned prices are always including VAT and all other mandatory fees to be paid by the customer. If transport, reservation or administrative costs are charged, this will be mentioned separately. The indication of price only refers to the articles as described verbatim. The accompanying photo is decorative and may contain elements or items that are not included in the price. Colors may differ slightly from the colors on the photos. All prices on the site are subject to printing and typing errors. No liability is accepted for the consequences of printing and typing errors.

 

Article 3: Offer

 

The articles are intended for normal private use only. Despite the fact that the catalog and website are compiled with the utmost care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date.

If you have specific questions about sizes, color, availability, delivery time or delivery method, please contact our customer service beforehand (see article 12). Skateshop.be is only responsible for the correctness, updating, or completeness of the information offered. Skateshop.be is in no way liable in the event of material errors, typesetting or printing errors. The offer always applies as long as the stock lasts and can be changed or withdrawn at any time by Skateshop.be. Skateshop.be is entitled - without stating reasons - to refuse orders, to adjust delivery times, to split deliveries or to attach other conditions to delivery.

 

Article 4: Online purchases

 

The customer has the possibility to purchase the articles from the Skateshop.be assortment online. The purchase is made at the moment the customer receives a confirmation email from Skateshop.be. The customer has the choice between the following payment methods: iDeal / Mastercard / Visa / Bancontact / Maestro

 

Article 5: Reservation of ownership

 

The delivered items remain the exclusive property of Skateshop.be up to the moment of full payment by the customer. However, the risk due to loss or damage passes to the customer from the delivery. The customer undertakes, if necessary, to point out to third parties the retention of title of Skateshop.be, for example to anyone who seized the not yet paid items.

 

Article 6: Sanctions for non-payment

 

Without prejudice to the exercise of other rights owned by Skateshop.be, in the event of non-payment or late payment, the interest of 10% per annum on the unpaid amount will be due by law and without notice from the date of default. In addition, the customer is legally and without notice a flat-rate compensation of 10% on the amount involved, with a minimum of 25 euros per invoice. Notwithstanding the foregoing, Skateshop.be reserves the right to take back the (fully) paid items.

 

Article 7: Complaints

 

Any visible damage and / or qualitative shortcoming of an article or other shortcoming on delivery must be reported within 48 hours after delivery, under penalty of forfeiture of any right.

 

Article 8: Warranty

 

  1. Legal guarantee (only for consumers)

Pursuant to the law of 21 September 2004 concerning the protection of consumers in the sale of consumer goods, the consumer has legal rights. Each item is subject to the legal guarantee from the date of purchase by (if necessary delivery to) the first owner. Every commercial guarantee leaves these rights unabated.

The provisions of this article only apply to customers who purchase articles online as consumers:
The consumer has the right to notify Skateshop.be that he renounces the purchase, without payment of any penalty and without giving any reason within 14 days from the day following the delivery of the product.
Customers who wish to make use of the renunciation right must contact the Skateshop.be customer service department within 14 days from delivery and return the goods within 20 days from delivery to Skateshop.be, Eiermarkt 7, 8000 Bruges. 
We provide a free return ticket, which can be printed and taken to a GLS parcel shop near you.
Only articles that are in their original and undamaged packaging, together with all accessories, instructions for use and invoice or proof of purchase can be returned.

Article 10: Privacy

 

Skateshop.be undertakes to use your data solely for the execution of the concluded agreement that you conclude by means of your order and to send you information from Skateshop.be without obligation.

If you also want to receive information via e-mail, please also provide us with your e-mail address. We treat your information as confidential information and will never pass on, rent or sell it to third parties. You can request, correct, change or have your data stored in the Skateshop.be customer list at any time and you can refuse that Skateshop.be uses your data to send you information. The customer is responsible for keeping his log-in data confidential and the use of his password. Your password is stored encrypted, so Skateshop.be does not have access to your password. You have access via your user profile to all the information available about you on Skateshop.be for consultation, modification or removal.

The customer accepts that electronic communications and backups can serve as proof.

 

Article 15: Applicable law - Competent court

 

Belgian law applies, with the exception of the provisions of private international law with regard to applicable law and with the Rome-I regulation on international purchase agreements concerning movable property. In case of disputes, only the courts in Antwerp are competent.
