Terms and Conditions
In the event of discrepancies or differences in interpretation, the Dutch version of these terms and conditions shall prevail.
Article 1: General provisions
The electronic webshop of Hurray Retail (Skateshop.be), a private limited company with registered office at Europark-Zuid 7c, 9100 Sint-Niklaas, Belgium, VAT BE0599985382, Antwerp Company Register, hereinafter referred to as “Skateshop.be”, offers its customers the possibility to purchase products from its store online, including but not limited to shoes, clothing, skateboard hardware and accessories.
These terms and conditions apply to all products from the Skateshop.be assortment and to every purchase made by the customer through Skateshop.be.
The customer accepts that these terms and conditions are exclusively applicable, to the exclusion of any of the customer's own general or specific purchasing conditions.
Article 2: Prices
All prices stated are inclusive of VAT and all other taxes legally payable by the customer. Shipping, reservation or administrative costs, if applicable, will be stated separately.
Prices apply exclusively to the products as described. Images are for illustrative purposes only. Colours may slightly differ from actual product colours.
All prices are subject to typographical, printing and programming errors. No liability is accepted for the consequences of such errors.
Article 3: Products and orders
The products offered are intended exclusively for normal private use.
Although the website is compiled with the greatest possible care, the information provided may be incomplete, contain material errors or not be fully up to date.
For specific questions regarding sizes, colours, availability, delivery times or shipping methods, customers are requested to contact customer service before placing an order.
Offers are valid while stocks last and may be modified or withdrawn at any time by Skateshop.be.
Skateshop.be reserves the right to refuse orders, modify delivery times, split deliveries or attach additional conditions to deliveries. This may occur, among other reasons, in cases of excessive returns, repeated unfounded complaints, suspected abuse of the return policy, suspected fraud or behaviour contrary to good faith.
Article 4: Online purchases
Customers may purchase products from the Skateshop.be assortment online.
The purchase agreement is concluded when the customer receives an order confirmation email from Skateshop.be.
Customers can pay using the payment methods offered on the website, including iDEAL, Mastercard, Visa, PayPal, Bancontact and Maestro.
Article 5: Retention of ownership
Delivered products remain the exclusive property of Skateshop.be until full payment has been received from the customer.
The risk of loss or damage passes to the customer upon delivery.
Article 6: Complaints upon delivery
Customers are requested to report visible damage, delivery errors or obvious quality defects to customer service as soon as possible after delivery.
In order to properly assess a complaint, Skateshop.be may request clear photographs of the product, packaging, labels, soles, product details and any reported damage.
Minor product variations, light glue marks, minimal production tolerances, slight finishing deviations, colour differences or other characteristics considered acceptable under the manufacturer's quality standards shall not be regarded as defects.
Skateshop.be reserves the right to refuse complaints if the product has been used, damaged, soiled, returned incomplete or handled in a way that exceeds normal inspection as would reasonably be permitted in a physical retail store.
Article 7: Warranty
a. Legal warranty for consumers
Consumers benefit from the legal warranty rights provided under applicable Belgian and European consumer legislation.
Any commercial warranty does not affect these statutory rights.
b. General warranty conditions
To invoke warranty rights, the customer must provide proof of purchase.
For products purchased online, the customer must first contact customer service. Skateshop.be will then provide instructions regarding the warranty assessment procedure.
Any defect must be reported within a reasonable period after discovery.
Warranty does not apply to defects or damage caused by accidents, negligence, falls, abnormal or improper use, use contrary to the intended purpose, failure to follow instructions, modifications to the product, rough handling, poor maintenance or normal wear and tear.
Warranty also does not apply to wear items or products with a limited lifespan unless a legally recognised defect is present.
The warranty is non-transferable.
Article 8: Right of withdrawal and returns
The provisions of this article apply only to customers acting as consumers purchasing products online.
Consumers have the right to withdraw from the purchase within 14 days from the day following delivery, without giving any reason.
The customer must contact customer service within this period and return the goods in due time to the return address of Skateshop.be: Noordzandstraat 86-88, 8000 Bruges, Belgium.
Products may only be inspected and tried on as would reasonably be possible in a physical retail store. Customers may not use the product beyond what is necessary to determine its nature, characteristics and functioning.
If a returned product has suffered depreciation due to use, damage, dirt, missing parts, damaged packaging or handling beyond normal inspection, Skateshop.be reserves the right to charge compensation for the loss in value.
Only products returned complete, clean, undamaged and, where reasonably possible, in their original packaging are eligible for full reimbursement.
Skateshop.be may, at its own discretion, offer a free return label. Free return labels can only be provided for returns shipped from Belgium.
For returns from other countries, return shipping costs are always the responsibility of the customer unless explicitly agreed otherwise.
In cases of excessive returns, repeated disputed quality claims, unfounded complaints or suspected abuse of the return policy, Skateshop.be reserves the right to charge return costs or to no longer provide prepaid return labels.
Skateshop.be reserves the right to refuse return requests or future orders in cases of suspected abuse of withdrawal rights, fraudulent claims, excessive returns or behaviour contrary to good faith.
The following products will not be accepted for return:
- used, soiled, damaged or incomplete products;
- products made to customer specifications;
- products which cannot be returned due to their nature;
- products missing labels, accessories or essential parts.
Article 9: Privacy
Skateshop.be undertakes to use personal data solely for the execution of the agreement, order processing, customer service and, where consent has been given, communication regarding Skateshop.be.
Data is treated confidentially and will not be sold, rented or disclosed to third parties without legal grounds.
Customers may request access to, correction or deletion of their data by contacting [email protected] or by post at Skateshop.be, Noordzandstraat 86-88, 8000 Bruges, Belgium.
Customers are responsible for maintaining the confidentiality of their login credentials and password.
Skateshop.be uses cookies to ensure the proper functioning of the website and ordering process.
Article 10: Validity and waiver
If any provision of these terms and conditions is declared invalid, unlawful or unenforceable, this shall not affect the validity of the remaining provisions.
Failure by Skateshop.be to enforce any right shall not be considered a waiver of such right.

Article 12: Amendments to the terms
Skateshop.be reserves the right to amend these terms and conditions. Any purchase following such amendments constitutes acceptance of the updated terms.
Article 13: Evidence
The customer accepts that electronic communications, order records, payment data and backups may serve as evidence.
Article 14: Applicable law and competent courts
These terms and conditions are governed by Belgian law.
Any disputes shall fall under the exclusive jurisdiction of the competent courts of Antwerp, insofar as permitted by law.
